Altalaya Terms of Use

Welcome to Altalaya. By creating an account or using the app, you agree to these Terms of Use (“Terms”). If you do not agree, do not use Altalaya.
These Terms also apply to our public website (legal pages and related materials such as APK download links), except where a section clearly applies only to the mobile app.
Altalaya is a community map of viewpoints (miradors). We believe in transparency: we do not sell your personal data, and we do not invent fake community statistics.
1. The service
Altalaya lets you:
- Discover and share outdoor viewpoints
- Upload photos and text about spots (from your device photo library)
- Save spots to a personal list
- Use the map and sun / golden-hour helpers
- Manage your profile and your own content
- Report spots and block users that break community standards
- Optionally support the project as an Early Founder (voluntary payment via Stripe)
We may change, suspend, or discontinue features at any time. We are not obligated to keep every spot online forever.
2. Eligibility
You must be old enough to form a binding contract in your country (and at least 13, or the higher age required where you live). You are responsible for your account and for keeping your login details safe.
3. Respect the places you visit
Altalaya points to real places. Using the app does not give you any right to enter private property, ignore local laws, or damage nature.
When you visit or publish a spot, you agree to:
- Follow all local laws, park rules, access restrictions, and private-property signs
- Stay on permitted paths and respect closures
- Leave no trace: take your trash, do not vandalize, do not disturb wildlife or fragile habitats
- Be considerate of residents, landowners, and other visitors
- Not encourage dangerous, illegal, or harmful access (for example cliff edges with no safe approach, trespass routes, or restricted military / private land)
You visit outdoor locations at your own risk. Nature, weather, terrain, and other people are unpredictable. Altalaya does not guarantee that any spot is safe, open, accurate, or legally accessible.
4. Your content (UGC)
You may upload photos, titles, descriptions, tags, and other materials (“Content”).
Your rights and license
You keep ownership of your Content. By posting it, you grant Altalaya a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that Content inside the app and related services, solely to operate and promote the community map.
You can delete your Content in the app. After deletion, it will no longer be publicly available, subject to short-term backups and legal retention needs.
Your responsibilities
You confirm that:
- You have the rights needed to post the Content (including photo rights and permission of recognizable people when required)
- Your Content is accurate enough not to mislead others about access, danger, or ownership
- Your Content does not violate these Terms or the law
5. Prohibited content and behaviour
We will remove inappropriate Content and may suspend or ban accounts that post or do any of the following:
- Illegal content or activity
- Hate, harassment, threats, or targeted abuse
- Sexual content involving minors, or any exploitative sexual content
- Graphic violence or gore beyond what is reasonably incidental to outdoor reporting
- Spam, scams, phishing, or malware
- Impersonation or fake accounts meant to deceive
- Content that deliberately reveals private personal data of others without consent
- Content that promotes trespass, environmental damage, vandalism, or unsafe stunts
- Copyright or trademark infringement
- Anything else that seriously harms users, places, or the integrity of Altalaya
We may remove Content or restrict accounts with or without prior notice when we believe it is necessary for safety, legality, or community standards.
6. Reporting, blocking, and moderation
If you see Content that breaks these Terms, you can:
- Report a spot from the mirador detail menu (⋯ → Reportar), optionally with a reason
- Block a user (⋯ → Bloquear) so their spots are hidden on your map
- Contact us by email or via in-app feedback (Settings → Enviar comentarios)
How it works:
- A block is personal: it filters that author’s spots from your map view. It does not delete their content for other users.
- A report queues the spot for moderation review. Reporting does not automatically delete the spot for everyone.
- We may remove Content, restrict accounts, or take other action we consider reasonably appropriate for safety, legality, or community standards.
- Abuse of report/block features (harassment via false reports, evasion, etc.) may itself lead to restrictions.
We do not pre-screen all Content. Presence of Content in the app does not mean we endorse it.
7. Location and maps
Location permission is optional and used only while the app is in use, mainly to center the map and help with sun-position features. See the Privacy Policy for details.
Map data may come from Google Maps and other providers. Map accuracy is not guaranteed. Map display preferences you choose in Settings are stored on your device.
8. Early Founder support
Early Founder support is optional. Payments are processed by Stripe. Supporting Altalaya may unlock a founder badge and related recognition in the app. Support does not:
- Transfer ownership of Altalaya
- Guarantee specific future features or timelines
- Create an employment or partnership relationship
- Exempt you from these Terms
Refunds, if any, follow Stripe’s process and applicable consumer law. We may revoke founder status obtained fraudulently.
9. Third-party services
Altalaya relies on third parties such as Supabase (auth, database, storage), Google (sign-in / maps; Analytics on the website only with consent), Stripe (optional payments), and our website host. Their own terms and privacy policies apply to their services. We are not responsible for outages or decisions made solely by those providers.

10. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT ALLOWED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- Spot information is complete, current, or safe
- The app will be uninterrupted or error-free
- Photos or descriptions reflect current on-site conditions
Outdoor activity involves risk of injury or property damage. You assume that risk.
11. Limitation of liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, ALTALAYA AND ITS OPERATORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR FROM VISITS TO LOCATIONS SHOWN IN THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP OR VOLUNTARY SUPPORT IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) EUR 50 — EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW (FOR EXAMPLE, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE SUCH LIMITATION IS FORBIDDEN).
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
12. Termination and account deletion
You may stop using Altalaya, delete your Content, or delete your account from Settings at any time. We may suspend or terminate access if you break these Terms, create risk for others, or if we shut down the service.
Account deletion removes your profile and associated user content as described in the Privacy Policy. Provisions that by nature should survive (including licenses already exercised, disclaimers, and liability limits) will survive termination.
13. Changes to the Terms
We may update these Terms. We will update the “Last updated” date and may notify you in the app. Continued use after changes means you accept the new Terms. If you do not agree, stop using the app and remove your Content.
14. Governing law
These Terms are governed by the laws of the country where the Altalaya operator is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply and cannot be waived.
